Introduction :

Test In these terms and conditions, “we” “us” and “our” refers to Lendress. Owners or people listing their garments are referred to as lenders, whereas renters or leasers are referred to as lendees. The access and use of information on this website, including the rental of clothing through our website or mobile application, are provided subject to the following terms and conditions. It is the customers (lender or lendee) responsibility to read and follow the terms and conditions below. Accepting a delivery, renting, listing and lending an item through us constitutes the acceptance of our terms and conditions. Failure to read or abide by the terms & conditions constitutes a violation of these and therefore are automatically not the responsibility of Lendress. Lendress also reserves the right to amend this notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions. We therefore recommend that each time you access our website you read these terms and conditions. Lenders (owners) and Lendees (renters) have the liberty to discuss the specification of hire such as delivery time, place, cancellation, extension of rent, with all payments, refunds or dispute resolution being handled by the platform and lendress’ admin team. Both lenders and lendees reframe from engaging in actions which conflict with the terms and conditions, violation of these, will result in a final warning, prior to being banned from the platform.

Our Services :

Our services are provided to adults over the age of eighteen (18) years. By proceeding to transact or rent through our website, you acknowledge that you are over 18 years of age.

Lendress is an online marketplace through platform, for lenders and lendees to lend/rent garments to one another. We strive to ensure that the listed products are described as accurately as possible on our website, however we do not warrant that the description is accurate as it is mainly controlled by Lenders. Where we become aware of any incorrect description, we and the Lenders reserve the right to correct any error or omission without notice.

Images have been provided for illustrative purposes only and we do not guarantee that any image will reproduce in true color nor that any given image will reflect or portray the full design or options relating to the product.

Lendress also does not take ownership of any images posted on our website by lenders or lendees, hence, the responsibility is held by the lender or lendees themselves.

Payment :

In addition to the payment of the applicable rental price (including delivery & cleaning fee) for goods delivered through the Website or Mobile App. Lenders are responsible to include cleaning fees to their rental price, whereas Lendress will include the delivery fee to the same price. All other costs which may include returns, repairs or refunds for damages will be bared by the lendees.

Payments between renters and lenders are handled by the platform prior to a lendee using a garment. Lendees also agree to allow Lendress to charge their credit cards, should a lender raise a case with our admin team, in the event of damage, theft or loss of a garment. Lenders also agree to hold Lendress free of any liability in the event of damage, theft or loss of a garment, as their use of the platforms constitutes consent to the risks associated with lending to third parties (lendees). Lendress will handle all disputes between Lenders and Lendees, and is responsible to compensate financially the affected party where we deem necessary. Lendress also does not take ownership of any images posted on our website by lenders or lendees, hence, the responsibility is held by the lender or lendees themselves.

Wearing of a Hired Item :

A customer (lendee) must pay for the possession and responsibility of an item upon reception of the piece(s) and satisfaction with its condition and fit. Lendees also agree to have a deposit amount blocked from their credit cards, corresponding to 90 % of the garments retail price, which will be taken upon confirmation of the rent. In case of a lendee refusing to accept a delivery, unsatisfied with the condition or fit or a garment, they must decline a rent on the app or website, and liaise with lendress admin, to have their payments refunded which can take an average of 5 to 7 working days minus a delivery fee. In case the garment is damaged or dirty (without it being stipulated on the platform), the delivery fee is to be incurred by lenders. Items can be rented for more than one day, but the rental is not transferrable from one lendee to another. In the event of a lendee wishing to wash a garment, they can do so, but are automatically liable for any damage or loss of the same. This caretaking of a garment does not constitute an exemption to the cleaning fee imposed by Lenders.

After wearing and returning an item, or if an item in classified as undeceivable, Lendees are expected to rate an item and its lender with the following parameters:

Fit/Size; State/Condition/Look; Cleanliness. A lendee can only provide a rating after using a garment, or in the event the garment in damaged or dirty, to reinforce trust amongst lendress’ user base.

Condition of An Item :

It is an owner’s responsibility to provide the customer with an item that is in wearable and undamaged condition. Small stains, that are hidden or barely noticeable, are accepted. However, please disclose these stains to the customer before they hire the item on the platform. A customer has the right to refuse to wear an item, if a reasonable person, in this position, would also view the item as un-wearable.

An item that has small stains but is still wearable can also be refused by the customer, if these damages were not disclosed prior to the rental.

In the scenario of a marked or damaged item, it must be immediately returned to the owner, and a full refund be issued. If disputes between owner/customer occur, please send in a detailed complaint, along with photo evidence to Lendress admin team, and we will determine the damage, as well as the refund.
